In order to provide the best possible service to our stakeholders, Work in Action Ltd. (Data Controller) needs to collect and process personal data about the people who use our services. (Stakeholders' are our, customers, visitors, guests, contractors, volunteers, staff etc.)
What personal information do we collect about you?
Personal information (or data) we collect in this sense is information which could either directly
or indirectly identify you. For example, your name, address, date of birth, NI number, identity
card details, country of birth, nationality; information relating to your education and employment
history, email details, phone number; your family or personal circumstances (e.g. where this
information is relevant to how we support you). We may also need to collect sensitive personal
data, for example, concerning your health and medical conditions (e.g. disability status), certain
criminal convictions, information about your racial or ethnic origin, religion or similar beliefs; sexual orientation etc.
The information held is the absolute minimum necessary to enable us to offer our services to our users.
How do we collect your information?
We collect your personal information in a number of ways including:
from the information you provide to us when expressing your interest in using our services;
when you formally register with us to use our services; when you communicate with us by telephone, or email; when you visit our website (If you view our website for example, whilst you do not need to provide us with any personal information, your browser will automatically transmit some data, such as the date and time our web pages were viewed, your browser type and settings, your IP address etc.); information via CCTV footage (Due to our ongoing quest to ensure the safety and security of all of our service users there may also be CCTV in operation within our buildings. Again, where this is the case the footage for this is stored for only the minimum amount of time needed for us to ensure the absolute safety and security of you and all of our stakeholders) ; or via third parties (e.g. The Jobcentre Plus).
How we use your information
The purposes for which we may use personal information (including sensitive personal information) include: to improve our services and products; to register you on to our programmes in order that you may gain access to our services; to manage your progression; attendance monitoring, maintaining service user records; help monitoring equal opportunities; safeguarding and promoting the welfare of service users; ensuring service user safety and security; administrative purposes, including: carrying out research and statistical analysis such as service user satisfaction surveys; carrying out audits (e.g. to ensure compliance with our regulatory and legal obligations); promoting our services (e.g. future learning opportunities, or other events happening on and off site); to meet the performance requirements of our contracts;
The legal basis for processing your information
We process your personal data as part of our public interest task of providing an employment & skills service to you and to meet our statutory obligations as an employment & skills provider. In this respect, we use your personal data in the following way:
to interact with you as part of the admissions process (e.g. answer enquiries about our services); dealing with any concerns or feedback you may have; to monitor and evaluate the performance and effectiveness of the organization, including by training our staff or monitoring their performance; to promote equality and diversity and safeguarding within our organization; to seek advice on our rights and obligations, such as where we require our own legal advice. We may also process your personal data for compliance with our legal obligations. In this respect, we may use your personal data for the following: to meet our compliance and regulatory obligations to Government agencies, funding and exam bodies, compliance with anti-money laundering laws and safeguarding requirements; for the prevention and detection of crime; in order to assist with investigations (including criminal investigations) carried out by the police and other competent authorities. We may also process your personal data where: it is necessary for medical purposes (e.g. medical diagnosis, provision of health or social care or treatment, or a contract with a health professional); it is necessary to protect you or another person’s vital interests; or we have your specific or, where necessary, explicit consent to do so.
We may use your personal data for marketing purposes (e.g. Where we send you communications about services we deliver that you have shown or expressed an interest in, or where we think you might benefit from such services etc.), but only where we have your consent. However, we may have to provide your personal information without your consent, for example, to prevent fraud, report a criminal act, or to prevent serious risk etc. Apart from in these types of instances, we will not share your information except where you have given your consent, or where we are required by law to do so, or where this facilitates our providing you with agreed services, or where we are working with other stakeholders on your behalf (e.g. the Jobcentre Plus, or other providers) etc. Whilst our legitimate organizational interest provides us with a legal basis for this type of communication, you of course have the opportunity to opt out of such communications at any time , either at the time (e.g. when you are filling in forms on our website or a hard paper copy, there will usually be a tick box which you can leave unticked, if you don't want to disclose your personal information for marketing purposes), or subsequently, by either unsubscribing (in the case of email communications, or by contacting us via the details supplied in this policy.

We are fully committed to securing your data and keeping it confidential, & have taken all reasonable precautions to prevent data theft, unauthorized access, and disclosure by implementing technologies and software, which help us safeguard all of the information we collect online.
